Welcome to KOYN FX. These Terms of Service ("Terms") govern your access to and use of our AI-powered forex trading platform. By using KOYN FX, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing our platform, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not use KOYN FX.

2. Eligibility

To use KOYN FX, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using financial services under applicable law
• Reside in a jurisdiction where forex trading is legal
• Comply with all local laws and regulations regarding online trading

3. Account Registration

Account Creation

• You must provide accurate and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorized use of your account
• One account per person; multiple accounts are prohibited without prior approval

Account Security

• Use a strong, unique password
• Do not share your API keys or authentication tokens
• Enable two-factor authentication when available
• You are liable for all activities conducted through your account

4. Subscription Plans and Billing

Free Tier

• 1 free AI analysis per account
• Limited features and support
• No payment required

Starter Plan ($99.99/month)

• 500 AI analyses per month
• Full platform access including Auto Pilot
• Email support
• Billed monthly via Stripe
• Note: Auto Pilot consumes ~864 credits/day (24/7 on 3 symbols)

Pro Plan ($199.99/month)

• 1,000 AI analyses per month
• Autonomous trading features (Auto Pilot)
• Priority support
• Advanced analytics
• Billed monthly via Stripe

Billing Terms

• All fees are in USD and billed monthly in advance
• Payments are processed securely through Stripe
• No refunds for partial months or unused analyses
• You may cancel at any time; access continues until the end of your billing period
• We reserve the right to change pricing with 30 days' notice

Credit System

• Each AI analysis consumes 1 credit
• Credits are allocated monthly and do not roll over
• Unused credits expire at the end of the billing cycle
• Both Starter and Pro users can use Auto Pilot, but should monitor credit consumption
• Credits cannot be transferred, sold, or refunded

5. AI-Powered Trading Services

Service Description

KOYN FX provides:

• AI-powered market analysis and trading signals
• Real-time chart analysis and technical indicators
• Integration with TradeLocker broker accounts
• Autonomous trading recommendations (Pro tier)
• Social trading features and content sharing

No Financial Advice

AI Limitations

• AI analysis is based on historical data and may not predict future performance
• Market conditions can change rapidly, making predictions outdated
• Technical issues or data delays may affect analysis accuracy
• AI models are continuously improving but are not infallible

6. Trading Risks and Disclaimers

Financial Risk

• High Risk: Forex trading can result in substantial losses, including loss of your entire investment
• Leverage: Leveraged trading amplifies both gains and losses
• Volatility: Markets can be highly volatile and unpredictable
• No Guarantees: Past performance does not guarantee future results

Autonomous Trading Disclaimer

• Autonomous trading features execute trades automatically based on AI recommendations
• You retain full responsibility for all automated trades
• Monitor your account regularly; automated trading does not guarantee profits
• You can disable autonomous trading at any time
• We are not liable for losses from autonomous trading decisions

7. Broker Integration

KOYN FX integrates with third-party brokers (e.g., TradeLocker):

• You must comply with your broker's terms and conditions
• We are not responsible for broker downtime, errors, or policy changes
• Your broker credentials are encrypted and stored securely
• We do not have access to withdraw funds from your broker account
• You may disconnect your broker at any time

8. Prohibited Activities

You may not:

• Use the platform for illegal activities or money laundering
• Attempt to hack, reverse engineer, or compromise system security
• Share your account or API keys with unauthorized parties
• Use automated bots or scrapers without permission
• Manipulate or abuse the credit system
• Post spam, malicious content, or fraudulent signals
• Impersonate others or provide false information
• Violate any applicable laws, regulations, or third-party rights

9. Intellectual Property

Our IP

• KOYN FX owns all rights to the platform, including AI models, code, and branding
• You may not copy, modify, or distribute our software without permission
• Our trademarks and logos may not be used without written consent

Your Content

• You retain ownership of trading strategies and content you create
• By sharing content publicly, you grant us a license to display and distribute it
• You are responsible for the accuracy and legality of content you post

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• KOYN FX IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
• WE ARE NOT LIABLE FOR TRADING LOSSES, MISSED OPPORTUNITIES, OR DATA LOSS
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE PAST 12 MONTHS
• WE ARE NOT LIABLE FOR THIRD-PARTY SERVICES (brokers, AI providers, hosting)
• WE DO NOT GUARANTEE UNINTERRUPTED, ERROR-FREE, OR SECURE SERVICE

11. Indemnification

You agree to indemnify and hold harmless KOYN FX, its officers, employees, and partners from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your trading activities and decisions
• Your content or conduct on the platform
• Your breach of any law or third-party rights

12. Termination

By You

• You may cancel your subscription at any time via the Stripe Customer Portal
• Access continues until the end of your billing period
• To delete your account, contact support@koynfx.com

By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or abusive behavior
• Fail to pay subscription fees
• Pose a security risk to the platform

We will provide notice when possible, but may terminate immediately for serious violations.

13. Changes to Terms

We may update these Terms periodically. Material changes will be communicated via:

• Email notification to your registered address
• Platform announcement or banner
• Updated "Last Modified" date at the top of this page

Continued use after changes constitutes acceptance. If you disagree, you must stop using the platform.

14. Governing Law and Dispute Resolution

Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.

Dispute Resolution

• For disputes under $10,000 USD, we encourage informal resolution by contacting support@koynfx.com
• Disputes may be resolved through binding arbitration
• You waive the right to participate in class-action lawsuits
• Courts in London, England have exclusive jurisdiction for non-arbitrable disputes

15. Miscellaneous

Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and KOYN FX.

Severability

If any provision is found invalid, the remaining provisions remain in full effect.

Waiver

Our failure to enforce any right does not waive that right.

Assignment

You may not assign these Terms. We may assign our rights to affiliates or successors.

Force Majeure

We are not liable for delays or failures due to events beyond our control (e.g., natural disasters, cyberattacks, pandemics).
